In this context, this text has been prepared to inform and enlighten you in accordance with the Personal Data Protection Law numbered 6698 (“Law”, “PDPL”) and other relevant regulations.

Information

The Personal Data Protection Law No. 6698 was accepted on March 24, 2016, and came into effect by being published in the Official Gazette on April 7, 2016. However, according to Article 32 titled “Enforcement” of the Law, Articles 8, 9, 11, 13, 14, 15, 16, 17, and 18 of this Law entered into force as of October 7, 2016.

The purpose of the Law is to protect the fundamental rights and freedoms of individuals, especially the right to the protection of personal data, and to regulate the principles and procedures to be followed by real and legal persons processing personal data. With this text, Maksim Trade Machinery Domestic and Foreign Trade Ltd. informs and enlightens visitors and presents the “Protection of Personal Data and Personal Data Sharing Consent” to the information and examination of visitors.

Maksim Trade Machinery Domestic and Foreign Trade Ltd. accepts, declares, and undertakes that it will not sell, rent, or use the names, email addresses, business and home addresses, phone numbers, and other personal data provided by visitors on this site to third parties in any way.

Processing of Your Personal Data

Processing of your personal data refers to all kinds of operations carried out on data, including obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making obtainable, classifying, or using data, either fully or partially, through automatic or non-automatic means, provided that it is a part of any data recording system.

Data Controller and Representative

In accordance with the Law, your personal data may be processed by Maksim Trade Machinery Domestic and Foreign Trade Ltd. as the data controller, within the scope explained in this text. Maksim Trade Machinery Domestic and Foreign Trade Ltd. is responsible for determining the purposes and means of processing personal data registered in the database, establishing and managing the data recording system. When the Data Controllers Registry is opened, it is declared that registration as a data controller will be realized.

Reasons for Processing Your Data and Data Transfer

Your personal data is processed for the purpose of ensuring that the necessary operational activities within the company are carried out to provide the products and services offered by our company to you, conducting the necessary work with the relevant business unit and business partners for the presentation of products and services suitable for your consumption and purchasing motivation, ensuring the rights of real persons by Maksim Trade Machinery Domestic and Foreign Trade Ltd., taking the necessary steps for the determination, implementation, and realization of commercial decisions by Maksim Trade Machinery Domestic and Foreign Trade Ltd., ensuring the legal security of Maksim Trade Machinery Domestic and Foreign Trade Ltd. and the individuals we have business relations with due to the relationships we have established, and similar purposes in accordance with Articles 5 and 6 of the Law.

Your Personal Data may be processed by Maksim Trade as the Data Controller without obtaining your additional express consent in the following cases:

a) It is explicitly prescribed in the laws;

b) It is mandatory for the protection of life or physical integrity of the person or someone else who is unable to express their consent due to actual impossibility or whose consent is not legally valid;

c) It is necessary to process personal data, directly related to the establishment or performance of a contract, provided that it is limited to the purpose of processing;

d) It is mandatory for the data controller to fulfill its legal obligation;

e) It has been disclosed by the data subject;

f) It is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, on condition that the data subject is informed in advance, and provided that the legal reasons and procedures are stated below, can be used for the following purposes.

Your personal data may be processed for the following purposes:

  • Communicating with you and others as part of our business.
  • Sending you important information about changes to our terms, conditions, and policies and other administrative information about our electronic services.
  • Ensuring quality, training, and security (for example, recorded or monitored phone calls to our contact numbers).
  • Resolving complaints and processing data access or correction requests.
  • Preventing, detecting, and investigating crime, including fraud and money laundering, and analyzing and managing other commercial risks.
  • Complying with applicable laws and regulations, including the obligation to comply with laws and regulations (including, outside your country of residence).
  • Managing our infrastructure and business operations, including audit, finance, accounting, billing, and collections; information systems; data hosting, management, and analysis; website hosting; and records, document, and print management.

  • Conducting market research and analysis, including satisfaction surveys.
  • Facilitating social sharing functionality.
  • Personalizing your experience with electronic services by presenting you with information and offers tailored to you.

To Whom and for What Purpose Your Processed Personal Data Can Be Transferred

Collected personal data may be transferred to our business partners, suppliers, shareholders, legally authorized public institutions, and private individuals within the scope of the personal data processing conditions and purposes specified in Articles 8 and 9 of the PDPL for the purpose of ensuring the legal and commercial security of Maksim Trade Machinery Domestic and Foreign Trade Ltd.; conducting the necessary work by our business units to offer products and services provided by our company to you; customizing the products and services offered by our company according to your liking, usage habits, and needs; and determining and implementing the commercial and business strategies of our company.

Method of Collecting Personal Data and Legal Basis

Your personal data is collected by Maksim Trade Machinery Domestic and Foreign Trade Ltd. to carry out commercial activities based on different channels and different legal bases. In this context, your personal data collected for this legal reason can also be processed and transferred for the purposes specified in Articles (b) and (c) of this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL.

Rights of the Personal Data Subject Specified in Article 11 of the PDPL

As personal data subjects, if you submit your requests regarding your rights as explained in this Information Notice to our Company through the methods specified below, our Company will conclude your request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the Personal Data Protection Board specifies a fee, our Company will charge the fee specified in the tariff determined by our Company. Within this context, personal data subjects;

  • Learning whether personal data is processed;
  • If personal data is processed, requesting information regarding it;
  • Learning the purpose of processing personal data and whether they are used in accordance with their purpose;
  • Knowing the third parties in the country or abroad to whom personal data are transferred;
  • Requesting the correction of personal data in case of incomplete or incorrect processing and requesting notification of the transaction made within this scope to third parties to whom personal data are transferred;
  • Requesting the deletion or destruction of personal data in case the reasons requiring their processing are eliminated, and requesting notification of the transaction made within this scope to third parties to whom personal data are transferred;
  • Objecting to the occurrence of a result against the person himself by analyzing the processed data exclusively through automated systems;
  • Requesting the compensation of the damage in case of damage due to the processing of personal data illegally;

Personal data subjects can use their rights mentioned above by sending their request containing the necessary information to identify their identity to our Company in writing or using the other methods specified by the Personal Data Protection Board, as the Personal Data Protection Board has not yet specified any methods at this stage. In this context, channels and methods for sending your applications to our Company in accordance with Article 11 of the PDPL are explained below in writing.
